Good Funds Settlement Act Notice

Please be advised effective September 14, 2015 pursuant to the Good Funds Settlement Act, all funds to closing in excess of $1,000.00 must be wired to our trust account for same day disbursement. Per the North Carolina Good Funds Settlement Act, “a settlement agent shall not cause a disbursement of settlement proceeds unless those settlement proceeds are collected funds.” Collected funds are defined as funds “deposited and irrevocably credited” to the trust account. Certified, official, and/or cashier checks are not considered collected funds on the same day they are deposited. We are sorry for any inconvenience or additional expense this may cause to you or our mutual client.
